This is a summary for buyers evaluating us, not a contract. Every shipment is governed by its own written sales confirmation and contract, agreed between Kivu Origins and the buyer before goods move.
Prices, availability and lead times shown anywhere on this site — including the landed cost estimator — are indicative and non-binding. A firm offer is issued in writing by our export desk and is only binding once both parties sign a sales confirmation.
We sell on FOB, CFR, CIF and DAP terms as defined by Incoterms 2020. Where a written contract references FCC (Federation of Cocoa Commerce) or ECA (European Cocoa Association) standard contract terms, those terms govern in the event of conflict with this page.
Payment is by bank transfer through RAWBANK, DR Congo, or by documentary letter of credit, as agreed per contract. First transactions with a new buyer are typically structured more conservatively on both sides.
Every shipment travels with its analysis bulletin. An independent weight and quality survey at loading is available on request. Where a shipment is shown not to conform to the contracted specification, we work to renegotiate terms in good faith before any formal dispute process.
The governing law and dispute-resolution mechanism (including whether FCC/ECA arbitration applies) will be confirmed here once reviewed with legal counsel, and will also appear in each signed sales contract.
